The Federal Republic of Republic Defense Army or RDA is a republic in asia. it was founded after the Asian Civil War,that destroys The Asian Republic.

RDA Constitution

★PREAMBLE★

“We the RDA People proclaim our mutual consent to Secure Liberty, Life; ensure justice and peace for the common defense. RDA shall not tolerate the rule of tyranny under any guise. A government of the people for the people and by the people shall be of the people. The natural rights endowed by our creator is law of the land inscribed in RDA Constitution.”

Article 1:Legislative Branch(having the power to make legal laws according to Constitution )

Section 1: Legislature (Legislative body of a country or state)

All powers are herein granted to the body of Congress of the Republic Defense Army are privileged to these senators as representatives of the electoral.

Section 2: The House of Congress

No Person who have not been in RDA for more then four weeks shall run for office of Congress. To run RDA must be their main group and state when they joined RDA.

When Openings happen in a Senator position by the means of, missing three sessions, resigning or quitting. The Chairman shall have the authority to issue a special election.

Congress shall elect their: The chairman,lady who been in RDA for 2 months can run. The person who has most votes behind the Chairperson shall be cochair. Before a Chairperson and Cochair enters their duty they shall take the Oath of Congress given by President.

“I do solemnly swear that I will support and defend the Constitution of the Republic Defense Army RDA against all enemies, foreign and domestic; that I will bear true faith and loyalty which I take this duty freely, without underlying motives; that I will faithfully discharge the duties of the office on which I am to enter: So help me God and may God bless RDA.”

Chairperson shall remain in office for four months and every four months a new chairperson shall have a number given to the Congress body as: 1st Congress and henceforth.

The Chairperson shall hold the fourth month election of senators before the President holds the Chair seat election which shall occur after senator election. On the 30th of the fourth month the Chair-powers shall dissolve. Then the new Chairperson shall be sworn in by the President as senators by the Vice president. This ceremonial rite shall occur every two months when a new chair and co chairperson are elected and sworn in with senators.

Congress shall have the power of impeachment to any office which shall be given a trial and vote of jury and signed by President,When constitution is violated: A Chair:person term is safe for 1 month, President safe for 5 months and if President is removed. The Vice President becomes President under limited powers constrained to any wars or bills under the President term for 1 months. If vice president is removed along with President then the chairman will hold office of President for two months and Sec of Law will hold elections for president following election standard.

Section 3: Elections, Meetings, Journals, Behavior.

Elections shall occur once every eight weeks. The elections shall be conducted by the Chairperson of Congress on 24th of each month. Chairperson shall allow RDA to enter or be nominated and vetted for meeting requirements to run shall occur 5 days before and last until elections start.Election shall last 6 days.

Senators of RDA Congress shall take oath of office given by Vice President and take seat the following day.

Chairperson of Congress shall: Appoint the chief of Staff, Conduct meetings,set a standard time and date of meeting and post bills up for voting following the order they are introduce in. They shall hold three different forums for three steps edit for suggestion of change by Congress then vote on edits and those with 2/3 of votes shall be added and lastly a vote on the Bill with the edits added.

Chairperson or cochair shall put up all bills requested by senators or RDA and may put up their own or one requested by President or Vice.

Congress shall have a minimum of ten senators.

Chairperson or cochair shall not vote but state present on each bill.

Congress shall meet at least once a week for one hour.

Congress shall vote under forums:

All of Congress shall have voted and have 2/3 of votes to pass. To get 2/3 take the amount of members such as the minimum members of Congress is ten times two then divide that by three would equal seven. 2/3 of Congress at a minimum number of ten equals to seven votes needed to pass a bill. The same formula is needed if Congressional numbers change.

At the end of each month the Chair person or Chief of Staff shall publish a summary and the recording of the meeting for RDA to see.

The Vice President shall preside over congress and ,act as a tie breaker and swear in the senators.

Members may expel a member of congress and state one of the reasons in court of an act conducting disorderly behavior in Congress and for non-proper attendance by 2/3 of the house.

Section 4: Compensation

The Senators shall receive a compensation of 1000 dollars  by the end of their services of serving 4 weeks.

Congress members shall not hold any other civil office under their term in congress.

Section 5: Declarable of bases as RDA, Main RDA Decal

Bills for declaring bases official property of RDA or declaring new RDA logos or decals shall originate in Congress or petition by members of RDA and those done before RDA Constitution shall be automatically legal.

Section 6: Powers Of Congress

Congress shall have power given to them by the consent of the people in respect to the Law of the Land.

To Regulate trade with clans and commerce.

To establish treaties or refused them.

To refuse to appointments to cabinet, or new offices, If the office is not filled in two weeks at the time of a new president or resignation of that post, congress shall hold elections for that office.

To establish construction of defensed bases,training bases:social bases shall remain in the right of the people to create, post teleports shall be official by the approval of congress.Any bases built before Constitution shall be legal.

To Propose Bills for declaring bases official property of RDA or declaring new RDA logos or decals shall originate in Congress or petition by members of RDA.

To promote the progress of tech and arms,scripts shall grant then a patent right to respective discoveries and inventors, by inducting them to RDA Hall of honorary service or achievement .

To define and punish piracies and felonies committed and offense against the Laws of Nations.

To declare War, rules of war concerning captures.

To mobilized and support Armies by the used of limited taxes to pay for service at end of one service in fulfillment of rank standing.

To maintain an RDA military holding elections for Sectary of War if Sec of war is impeached or President fails to appoint.

To set standard for accepting citizens members in to RDA, create a forum format to record the date of when they joined.

To grant off time to any RDA rank at request but during off time they must have a replacement.

To admit new states in to the Union by a full vote may be absent of two,create an office for it at the capital and create a forum officially declaring states of RDA

To pass any bill in the House of Congress it shall have all before it becomes law, be presented to the President, if approved and signed by the President it shall be law. If not it shall return to the Congress with 4 reason of objections. It shall be reconsidered by the Congress and modify or not and must be passed by a full vote of Congress and it shall be law and signed by the President who cannot veto it for a second time.

To Create Amendments to RDA Constitution must have full vote of the house. An Amendment cannot be shot down by the courts.

To impeach the President base on 2/3 of the vote in Congress and 4 votes of the High Military and 2/3 of all RDA. Then reviewed and testified before the judge and have a vote of 2/3 out of ten members of the jury.Approved by the sectary of law that the impeachment is reasonable. That the person action is in denial of duty or breached the Constitution more then once without trying to fix it, treated RDA in harsh a manner by showing contempt respect to RDA and neglecting their duty to maintain the role of service,highly inactive beyond the one week rule, abuses the ranking powers such as demoting a person without trial, exiled an RDA person without trial. These rules shall apply to the owner of RDA who's powers are also equal of the President but remain under the President legal jurisdiction. The rules of impeachment shall imply to all RDA ranks effected on the day the Constitution is Law of the Land.

Section 7: Limits of Congress

The Right of Habeas Corpus to right of trial shall not be suspended.

Congress shall not over tax and spend over their means.

No declaration of Nobility or title or award shall be granted by The RDA Congress or President to any person holding an office nor shall a member of Congress or President accept a gift to them personal from other nations of a person.

Congress shall not infringe on the Constitution of RDA.

Congress shall not give promotions to higher rank to friend of family or by bribe.

Congress cannot impeach a President who has not been in office past 5 months.

Congress cannot remove owner of RDA if he or she has not broken any laws of the Constitution or made amend to what was violated. Presidential impeachment process applies to owner as well.

Congress cannot remove a cabinet member from office unless found guilty of violating the constitution or of crimes and being inactive for more then one week, unless on approved break by congress.

Section 8: Powers prohibited of the States

Cannot declare war, cannot forge allies without Congress, shall be under protection of the RDA Army.

Article 2: Executive Branch

Section 1-President( Elected head of a Republican State)

The executive power be vested upon the President of RDA elected as servant. The term shall be of one year and shall not be able to run for office again. The Vice President shall be elected by coming in second behind the President.

No member of RDA who’s origin is not RDA or known as their first and loyalty to RDA.No person shall be eligible if they have not joined and remained in RDA for 12 months or have a major criminal history of more then one proven charge. RDA shall be your main group for 12 months and RDA description rank in your profile of when the person joined. To be eligible on recording the date you have joined under RDA census ,required of all members to create a forum of date on entrance to RDA.

Before the President elect is admitted to the execution of office: he shall take the RDA oath of office to uphold the Constitution.

The Founder of RDA shall conduct the oath of office,If not at hand the Sectary of Law shall conduct it.

The Republic Defense Army(RDA), and will to the best of my ability preserve,protect and fight for liberty and defend the people of RDA. The true free army. I shall preserve and follow the Constitution of RDA.So help me God"

• End of Oath*

The President shall be sworn in a week from being elected, with in that time the President must have selected his cabinet and be ready to carry out the duties of office.

Section 2-Presidential authority:Military,cabinet and appointments

President of RDA is Commander-in-chief of the Republic Defense Army and shall serve in wars as well.

The President shall be in charged of the RDA Divisions created by RDA congress of the Two main Divisions shall not be exceed the amount unless in event RDA gains 600 members in 5 months.

The President must form an active cabinet with in the 2 weeks of his affirming to office in event of failure to appoint cabinet, congress shall nominate 2 for a non appointed office by election.

The President shall: form allies,treaties, declaration of war by probable cause, admit states in to the Union and submit to congress for voting.

The President can conduct election for absent ranks.

The President can propose bills to go before congress.

The President shall hold training and make sure others are holding them.

The President is bound to a 24/7 duty and is allowed off time by a congressional request only if the President has people in place to run trainings and deal with RDA issues.

The President is only allowed 4 days off every two months at congress request.

When the President is on off time the Vice President may sign any bills in to law.

The President in fair manner can conduct or request changes to certain RDA bases,any major renovations of main RDA bases must notify RDA Congress or done so by it maker.

All the powers bound to limiting the President shall apply to the Vice president,Powers of the Vp shall not expand greater then the President but shall conduct the role of President when the official President is offline and it powers shall be limited when the President is online.

The President shall have final say in matters that can be conducted if the VP carried out duties during a President absent or offline.

Section 3: State Of Republic,Address before congress.

The President and his cabinet from year to year shall conduct a state of union before the RDA Congress and the refelladain people and inform them on the state of the nation.

Section 4: Disqualification of President and VP

The President is not above the law of the land, nor is any civil office of the Republic Defense Army.

(In event of impeachment,removal and resignation or quits, the Vice President shall obtain the office of the President,Chairman shall gain temporally defense war powers in times of war. The Chairman and VIce shall conduct elections no less then two weeks following the President absent of office.)

The President,vice president or any civil office or military shall be tried for impeachment and removed from office, for guilty of: Treason, Bribery, being a the highest leader of another group and more dedicated to a group other than RDA, abuse of power by demoting or promoting friends that have no skill or do not meet the requirements for such position.

Disservice to RDA,making profit from tech without helping RDA or inactive for more then one weeks\ or not attending RDA events,carrying out duties in orderly time period,wall posting on recent topics.

Article III - Judicial Branch ( Court system, Judgment of justice)

Section 1: Judicial Powers-(To Judge)

Sectary of Law must have served as a judge and shall appoint three judges exterior,Internal and Constitutional or Civil.He or She may appoint as many seen fit.

Shall appoint or find a lawyers minimum of ten lawyers. A jury of ten who are not connected to a court case.

The judicial authority of the RDA, will be trusted in the honest and non basis chief court of the land. It shall review the laws pass, conduct trials and maintain the rule of law. Judges shall judge on the rule of Law and the constitution and uphold the Law of the land.

A passing amendment cannot be shot down by the courts.

Section 2: Court trial by jury.

The Chief of courts known as Sectary of Law shall chose the jury.

The jury must be made up of members not connected to any person or event that make up the trial.

The trials shall be held by the lower court of internal affairs that have been committed upon RDA lands or property or sectors of raids in times of war

Trials concerning crimes committed on allied clan bases or neutral clans or concerning an allies shall be tried under the external  courts.

Section 3: Treason

Treason against RDA, Shall be of conducting of support in war against this union,giving aid or comfort or information. No person shall be convicted of treason, but on the testimony of 2 to 3 witnesses of the same act or confession by the accused traitor. Then shall be admitted to trial.

Section 4: Recording of courts

The court and sectary of office shall video and record and forum post a summary of the courts and trials and proceeding of the bills

Section 5: Admitting States

The Congress shall admit clans,groups as part of the union.

Entering Union shall gain two seats in RDA Congress

Shall gain tech approved for States and governor rank in RDA.

Section 6: Republican government

The Republic Defense Army shall uphold to every state that makes this union and to its people a Republican form of government that shall protect each of them against invasion.

Article V- Amendments to Constitution

Congress or President or a petition, shall be brought before the House of Congress 2/3 of the house must vote in favor and two/thi rds of the people must vote in favor and the courts must approve it legal constitutional. The President and Founder must sign it. If it passes it will amend a section or add amendment of this Constitution but it cannot remove the foundation of natural law if so the entire compact shall be void.

Article VI- Supremacy,Oaths

All oaths and laws before the adoption of this Constitution shall no longer be valid to the conduct of the land. It must be made by law of the congress under the Constitution, All oaths taken before this Constitution shall be void and taken again and any oaths taken under this Constitution shall be bound to the law of the land of this new confederation of the people and the states as guardians of the republic.

Thus this Constitution of the Republic Defense Army (RDA) which in by order be made, all treaties and judges and civic office of this day shall follow and adhere to the supreme law of the land.

Article VII-Citizenship (Legally recognized subject of a commonwealth)

Section 1-Citizenry (body of citizens)

All shall be a legal Citizen of RDA upon their 4 days in RDA.RDA shall be their Main group with their Rank and when they joined stated in their profile and Uniform bought. All who seek to become citizen of RDA shall swear to a Citizenry Oath to the Republic and to defend their natural rights and hold the elected official accountable to the Constitution.

No one shall be denied the right to vote but must have RDA as main group showing their Citizenship for vote to count.

Section 2- Citizenry Oath

"I do affirm my citizenship to this Republic Defense Army which I joined by my consent. To exercise the liberties by this Constitution. I shall conduct my duties as an equal to elect leaders and be a leader. I pledge to preserve RDA for the future. So help me Lord"

Article VIII- Ratification

Ratification by the conduct of the rdarain public and approval of the Congress and pre Constitutional President and governmental shall meet standards to ratify and establish this Constitution in harmony between the people and their government.

Declare the sovereignty of RDA a Republic, In witness of this creation of the Republic Defense Army (RDA). We here subscribed our names on the birth of the official Constitution for the Republic of RDA.

Bill of rights

1-Freedom of Speech, Press, Religion and Petition 

>Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

2-Right to keep and bear arms 

>A well-regulated militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed.

3-Conditions for quarters of soldiers

>No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

4-Right of search and seizure regulated 

>The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

5-Provisons concerning prosecution 

>No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation.

6-Right to a speedy trial, witnesses, etc. 

>In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

>In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise reexamined in any court of RDA, than according to the rules of the common law.
